The Nigerian Civil Aviation Authority (NCAA) has imposed a N5 million penalty on Qatar Airways for multiple violations of the country’s consumer protection regulations. The fine, announced by the NCAA’s Director of Public Affairs & Consumer Protection, Michael Achimugu, signals a more stringent regulatory approach towards international airlines operating in Nigeria.

“Glad to announce that, today, the NCAA has sanctioned @qatarairways to the tune of five million naira being penalty for consumer protection-related infractions,” Achimugu wrote on social media, adding that ongoing investigations into other cases may lead to further sanctions.

The regulatory action follows months of warnings to Qatar Airways over its alleged mistreatment of Nigerian passengers and consistent failure to comply with Part 19 of the NCAA Regulations 2023, which outlines minimum passenger rights and airline obligations.

The Trigger Incident

The immediate cause for the fine stemmed from a grave incident involving a Nigerian passenger on a flight from Lagos to the United States, via Doha. A Qatar Airways cabin crew member accused the male passenger of sexual harassment during boarding in Lagos. However, the allegation was only formally reported upon arrival in Doha, leading to the passenger’s arrest and 18-hour detention.

The NCAA investigation revealed that the passenger was subjected to a fine and compelled to sign a document written solely in Arabic, a language he did not understand. Following his release, Qatar Airways allegedly refused to allow him to continue his journey, forcing him to purchase a separate ticket at considerable financial and reputational cost.

The airline’s handling of the matter was further compounded by its disregard for the Nigerian regulator. The NCAA country manager for Qatar Airways allegedly failed to attend a scheduled meeting over the incident, opting to send subordinates instead.

The Economic Impact of Regulatory Discipline

The NCAA’s firm stance is rooted in a desire to enforce Nigeria’s aviation laws, but it also has crucial economic implications.

By enforcing strict adherence to consumer protection rules, the NCAA aims to build a predictable and fair operating environment. This is important because the perception that foreign airlines treat Nigerian laws with “disdain” as hinted by Achimugu deters trust and often leads to higher risk premiums for the Nigerian market.

Part 19 of the NCAA Regulations 2023 guarantees passengers clear rights regarding flight delays, cancellations, denied boarding, and compensation. Strict enforcement of these rules ensures that Nigerian travellers are not subjected to the severe financial and logistical costs associated with flight disruptions. When an airline complies, passengers are guaranteed compensation or re-routing options, protecting their travel budgets and reducing unexpected personal expenses.

Moreover, the fine sends a clear signal that foreign carriers must respect the laws of the host nation, just as they do in Europe and other highly regulated jurisdictions. Michael Achimugu warned: “It is against the law for ANY Airlines not to respond to the NCAA. It is against the law to provide false information to the NCAA. It is against the law to fail to comply with the provisions of Part 19…”

The NCAA disclosed that other airlines, including Royal Air Maroc and Saudi Air, have also been cautioned for similar infractions. The regulatory body is committed to applying “appropriate and stiff penalties against the airlines that, in perpetuity, fail to comply,” cementing Nigeria’s determination to establish itself as a market where passenger rights are non-negotiable.
