New Amnesty Window Opens for Unapproved Lagos Buildings

Lagos, Nigeria’s commercial capital, has announced a new two-month amnesty to allow owners of existing properties without the correct planning permits to legalise their buildings without facing the usual financial penalties. The Lagos State Ministry of Physical Planning and Urban Development confirmed that the 61-day window began on 1st November and will run until 31st December 2025, offering a critical opportunity for homeowners and developers to formalise their investments and avoid future sanctions, which can include demolition. The initiative is designed to encourage widespread compliance with urban planning regulations, leading to a more organised and safer built environment across the state.

This move is particularly significant for the state’s economy, as it represents a strategic effort to convert vast amounts of what is often referred to as ‘dead capital’ into ‘live capital’. Real estate professionals have enthusiastically backed the programme, noting its potential to stimulate growth in the housing sector. Operators within the building industry, speaking to the press, highlighted how this process could unlock immense value. “This amnesty is a momentous step to help ease the country’s huge dead capital burden,” one expert noted, referencing the estimated $1 trillion value of unregistered assets nationwide. “By providing legal titles and permits, these properties can be leveraged as collateral, significantly improving access to credit and strengthening the mortgage system.”

The government, while offering the waiver on penalties, insists that all applicants must still fulfil stringent compliance requirements to ensure structural integrity and safety. Property owners are required to submit a comprehensive set of documents to the Lagos State Physical Planning Permit Authority (LASPPPA) district offices or the Electronic Planning Permit office in Ikeja. Key submissions include the property’s title document or proof of ownership, an up-to-date survey plan, and evidence of tax compliance. Crucially, they must also provide a non-destructive integrity test report and a letter of structural stability for the existing building, ensuring that regularisation does not compromise public safety.

Officials say the amnesty is also part of a wider package of measures intended to cushion the effect of current economic hardships on the built environment sector, making it financially easier for citizens to comply. Dr Oluyinka Olumide, the Commissioner for Physical Planning and Urban Development, previously stressed that the administration is committed to enhancing compliance to guarantee an orderly and sustainable built environment. The ultimate goal, he explained, is a more transparent and legally secure property market, which, in turn, attracts local and foreign investment for infrastructure development. The state government has urged all property owners with unapproved structures to take full advantage of this brief window to secure their assets before the penalties are reinstated at the start of the new year.
